Return of old electronic devices and batteries

Information on the possibility of returning old electronic devices or batteries. As a distributor with an online store, we fulfill our obligations to take back old electrical appliances and batteries and to treat and recycle them in an environmentally friendly manner in accordance with the Waste Electrical and Electronic Equipment Ordinance (WEEE Ordinance) (Federal Law Gazette II No. 121/2005) and the Battery Ordinance (Federal Law Gazette II No. 159/2008).

We therefore inform our customers about the possibility of returning an old electrical appliance or batteries if the legal requirements are met.

According to § 5 (2) of the Waste Electrical and Electronic Equipment Ordinance (EAG-VO), "the final distributor is obliged to take back waste electrical and electronic equipment from private households at least free of charge at the request of the final consumer, provided that the returned equipment is equivalent and has fulfilled the same function as the equipment handed over. Final distributors are exempt from the obligation if their sales area is less than 150 m2 and the final distributor informs the final consumer of the exemption from the take-back obligation, in particular by means of a clear notice in the checkout area of the business premises. Final distributors who take back WEEE from private households free of charge must inform final consumers of this by means of clear notices, in particular in the checkout area of the business premises".

According to Section 5 (3) of the WEEE Ordinance, "in legal transactions in which the final distributor sells electrical and electronic equipment for private households by mail order, including electronic mail order, the final distributor may fulfill his obligation to take back WEEE by cash on delivery in accordance with paragraph 2 by setting up at least two publicly accessible points in each political district where WEEE from private households can be handed in by final consumers. These points and their opening hours shall be made known to final consumers by means of clear information, in particular in advertising materials and on the distributor's website.".

According to Section 9 (1a) of the Batteries Ordinance, "final distributors of portable batteries shall inform final consumers about the free return of waste portable batteries in a clearly visible place, if possible in the checkout area of the business premises. In addition, the final distributors of portable batteries shall place easily recognizable collection containers for waste portable batteries in an easily accessible and clearly visible place in the business premises. If certain waste portable batteries are not to be taken back via the collection container but directly by an employee free of charge, this must also be clearly indicated on the business premises".

According to Section 9 (2) of the Batteries Ordinance, "in legal transactions in which the final distributor sells portable batteries by mail order, including electronic mail order, the final distributor may fulfill his take-back obligation under paragraph 1 no. 4 by setting up at least two publicly accessible points in each political district where waste portable batteries can be returned by the final consumer. These points and their opening hours shall be made known to the final consumer in an appropriate manner."
